What Is The ERC Tax Credit?

Employers can claim a refundable tax credit called the Employee Retention Credit (ERC) against certain employment taxes during the COVID-19 pandemic. It’s not a loan and doesn’t need to be paid back. The ERC was created by the Coronavirus Aid, Relief, and Economic Security (CARES) Act in March 2020 so businesses can be encouraged to keep their employees on payroll even if they are experiencing financial hardship due to the pandemic. You can receive up to $26,000 per eligible W-2 employee for the following periods:

  • 2020: March 12, 2020, to December 31, 2020
  • 2021: January 1, 2021, to December 31, 2021

You had to have at least one eligible W-2 employee. Not including yourself or family.

You can now claim the ERC even if you received a PPP loan. Whereas before December of 2020, you could only claim either or. You can also claim the ERC even if you didn’t have a reduction in revenue due to the COVID-19 pandemic. To be eligible, businesses must have paid qualified wages to employees after March 12, 2020, and before January 1, 2023 as the IRS is only taking year 2020 and 2021 into account regarding the ERC. Only one of these have to apply to you in order to receive the funds for your business:

  • Social distancing requirements that reduced capacity
  • Reduction of hours of operation
  • Supply chain disruptions
  • Suspended on-site work or client meetings
  • Distribution delays or suspensions

Too Good To Be True? Scam?

I can understand why some would assume this is a scam. I myself never like to answer unsolicited calls, etc. This is a legit fund of 250 billion dollars back by the government. However, There are scammers out there giving false information regarding the ERC and trying to benefit off of it and just take advantage to capitalize off of this rare occasion. I’d advice you to do additional research to stay aware and educated on potential ERC scams.

However, I would never utilize my time by writing an article related to fraudulent activity. Though there are scammers out there, the ERC itself is not a scam and I would highly recommend businesses take action and claim their refund before the cut off. I would also advice you to visit the IRS website to educate yourself and take precautions on how to prevent being scammed regarding the ERC. I believe small businesses are the backbone of the U.S. and deserve this refund put in place to encourage businesses to keep their employees on payroll. Their hard work and dedication to their communities day in and day out are essential to a healthy economy. With the pandemic causing so much unexpected shifts, small businesses still remain and I believe this program is an excellent way to commend businesses that made it through the pandemic.
